HPK ONE OF TOP TEN LAW FIRMS

The Baltimore Business Journal has just published its annual list of the top 50 largest law firms in the Baltimore area.  HPK tied with Tydings & Rosenberg LLP for the number ten spot - a six spot jump from the previous year's ranking. Unlike the majority of law firms in the Baltimore area and across the country, for the past year and a half, HPK has been thriving, adding lawyers and legal staff, and growing its practice.

HPK ATTORNEY CHAD MALKUS TALKS TO STUDENTS ABOUT LEGAL CAREER

Chad Malkus, an attorney at Hodes, Pessin & Katz' Cambridge office, recently spoke to the Mace's Lane Middle School Project 2016 Group about the practice of law, careers in the legal field, and attending college and law school.  The project is part of an ongoing effort to keep minority students focused on grades, teach them how to be successful in life and about possible careers from community members.

TOWN OF BEL AIR COMPREHENSIVE REZONING AND REWRITE OF DEVELOPMENT REGULATIONS

The Town of Bel Air is accepting applications for rezoning of properties until December 31, 2009.  The Town will also to introduce a complete rewrite of the Development Regulations, including new form based zoning for the downtown, B-2 Zoning District and a portion of the Route 1, B-3 Zoning District.  The Town is expected to adopt the new zoning maps and Development Code in the first quarter of 2010.  This is an opportunity to change the zoning classification of your property and/or to amend the zoning code in order to accommodate your needs.  Bel Air Town property owners should contact Michael Leaf at 410.893.2333 or mleaf@hpklegal.com if they have any questions concerning the rezoning process or zoning code rewrite.

CHAD MALKUS - HPK ATTORNEY AND VICE-PRESIDENT OF THE ALZHEIMER'S ASSOCIATION MARYLAND CHAPTER BOARD - SUPPORTS 2009 MEMORY WALK FOR ALL AFFECTED BY ALZHEIMERS

Downtown Salisbury was filled with walkers Saturday morning who were out for a cause: the 2009 Memory Walk to fight Alzheimer's Disease.
Organizers say it is a fight that affects more than just the individual battling the disease. Chad Malkus, an attorney with the local law firm HPK and Vice-President of the Alzheimer's Association Maryland Chapter Board said, "It's not only devastating to the person, but it's devastating to the family around them: the caregivers. And it's just so important that the Alzheimer's Assocation is out there advocating for greater awareness.
"The fundraising campaign for the Alzheimer's Association continues until the end of November.

HPK IS PROUD TO ANNOUNCE THE ADDITION OF KIMYA BEHBAHANI TO THE FIRM'S LITIGATION GROUP

HPK is proud to announce that Kimya Behbahani has joined the firm's litigation group. Ms. Behbahani graduated from the University of Baltimore School of Law in May of 2009. While in law school, she completed an internship with the Honorable Alan L. Schwait of the Baltimore City Circuit Court and was accepted as a Fellow in the Snyder Center for Litigation Skills. In conjunction with her law degree she received a Certificate of Concentration in Litigation and Advocacy. 
Ms. Behbahani first joined HPK as a Law Clerk in 2008 working with the firm's litigation attorneys.  Upon admittance to the Maryland Bar, she will focus her practice in general civil litigation, insurance defense and probate and estate litigation.

Once again, HPK attorneys and staff proudly participated in the 2009 Baltimore Pride Festival.  Lead by HPK attorney Mark Scurti, they handed out HPK reusable bags, candy, brochures and the opportunity to win two tickets to the July 16th Young Victorian Theatre Group's performance of The Pirates of Penzance.  HPK, one of the few law firms in Maryland with a Same-Sex/LGBT Practice Group, has been proudly supporting and serving the LGBT community since 1988 and was the only law firm with a booth at the festival.

TOM GISRIEL, SUCCESSFULLY ARGUES TO HAVE WILL SET ASIDE ON GROUNDS OF UNDUE INFLUENCE

In a reported decision by the Court of Special Appeals, Tom Gisriel successfully argued that the Orphans' Court for Baltimore City erred in rejecting as untimely the appellant's Petition to Transmit Issues to the Circuit Court.  Russell v. Gaither, 181 Md.App. 25 (2008).  On remand, in a week long jury trial in the Circuit Court for Baltimore City, Tom successfully set aside a will on grounds of undue influence exercised by a fellow church member, causing the testator to execute a will naming her as a personal representative and another church member as a major beneficiary.

TOM GISRIEL SUCCESSFULLY ARGUES THAT PHOTOCOPIED WILL SHOULD BE ADMITTED TO PROBATE

In a ruling from the bench in the Circuit Court for Montgomery County sitting as the Orphan's Court, Tom Gisriel successfully argued that the decedent had not died intestate where a photocopy of the decedent's will existed.  Will photocopies are generally inadmissible as it is presumed that the original will was destroyed by the testator with the intent to revoke it.  Tom successfully overcame this rebuttable presumption and the photocopied will was admitted to probate.

GIFT TO SON FROM DECEDENT IS VALID

Tom Gisriel obtained a directed verdict in the Circuit Court for Baltimore City by successfully arguing the legality of a gift from the decedent to her son where the daughter challenged the validity of the gift of proceeds from the sale of the decedent's primary residence.

HPK ANNOUNCES CONTINUED EXPANSION WITH ADDITION OF JAMES R. BENJAMIN, JR.

HPK continues on its expansion road with the announcement today that the firm will be adding another attorney, James R. Benjamin, Jr.  The addition of Benjamin comes on the heels of HPK's addition of a Medical Malpractice Group, including three new partners, Natalie C. Magdeburger, Catherine W. Steiner, Mairi Pat Maguire, an associate, Elliott D. Petty, and a paralegal, Aristia V. Baysmore. 
James Benjamin, a former associate with Whiteford, Taylor and Preston, LLP, received his law degree from the University of Maryland School of Law.  Upon graduation he clerked for the Honorable Ellen M. Heller, Administrative Judge, Circuit Court for Baltimore City.  Benjamin has significant litigation experience in lead paint, condemnation, eminent domain actions, product liability matters and professional liability matters.  He also has appellate experience having successfully argued cases before both the Court of Appeals and Court of Special Appeals.  Benjamin is currently waiting on a decision in a case argued before the Court of Appeals last week in which one of the issues is the constitutionality of Maryland's lead paint statute.  In 2009, Benjamin was named a Rising Star by Super Lawyers magazine and in 2005 he was named one of Baltimore Business Journal's 40 under 40.

HPK MEMBER MICHAEL E. LEAF APPOINTED TO HARFORD COUNTY PUBLIC WORKS ADVISORY BOARD

On May 12, 2009, Michael E. Leaf, was appointed to the Harford County Public Works Advisory Board.  The Board meets regularly to review county policies and procedures and make recommendations to the County Director of Public Works.  Michael manages HPK's Business Services Group and practices out of HPK's Bel Air office located at 139 N. Main St.

JAMES R. BENJAMIN, JR. ARGUES BEFORE THE COURT OF APPEALS

On May 5, 2009, James Benjamin argued the case of  Zi'Tashia Jackson, et al. v. The Dackman Company, et al before the Court of Appeals.  The primary legal issues before the Court were (1) whether Maryland's Reduction of Lead Risk in Housing Act, Md. Code Ann., Env't §6-801 et seq. (2008), is constitutional, (2) what constitutes effective renewal under the Act (the date on which registration renewals are mailed to Maryland's Department of Environment or the date on which the renewals are received by MDE) and whether a property owner, who fell out of compliance but returned to full compliance, is once again afforded  qualified immunity under the Statute.   James argued that the Act is constitutional and that if a property owner was out of compliance, but returned to full compliance, he or she would be afforded immunity from suit for any injury that occurred during the period of full compliance. The Court's decision is currently pending.

HPK MEMBER MICHAEL C. HODES- A FRIEND TO PETS IN PERPETUITY

Michael C. Hodes was quoted in an article on pet trusts and was featured in a photo with his bird, Honey, in the Baltimore Sun Sunday, May 3rd edition.  The story discussed a new Maryland law, to be effective October 1 of this year, that will allow trusts to be set up to provide for the care of pets.  Basically, you will need to name a caregiver and a trustee to manage the money in the trust and reimburse the caregiver's expenses.  Prior to the law, pets were considered property under Maryland law that could not receive assets.  Click on the following link to view the full article.   www.baltimoresun.com/business/investing/bal-bz.ml.ambrose03may03,0,3403567.column

MICHAEL C. HODES CELEBRATES 25 YEARS IN TALK RADIO

Michael C. Hodes, co-founding member of Hodes, Pessin & Katz, P.A., is celebrating 25 years in Baltimore talk radio this month.  Michael began his talk radio career in Baltimore in April of 1984 on WCBM (AM-680) as a guest on Alan Christian's news/talk radio show.  Taking a brief hiatus, during which he frequently stepped in for HPK Member David Pessin on his WCBM show Planning Perspectives, Michael recently revived Financial Focus' run in February of this year.  The show can now be heard on FM 105.7.

MARYLAND DOMESTIC PARTNERS TO BE EXEMPTED FROM STATE INHERITANCE TAX

Gay domestic partners who co-own homes will be exempted from Maryland state inheritance tax under legislation approved by the Maryland General Assembly.  The Senate voted 27-18 to pass the measure.  The bill adds same-sex domestic partners to the list of family members who can inherit homes without paying taxes on that property.

The issue, entitled "Education and the Law" focuses exclusively on legal issues related to Maryland schools including school violence, constitutional issues and public charter school law.  Mr. O'Meally's article, "Searching Students in Maryland Public Schools" reviews the increasingly difficult burden placed on public educators and school administrators to create a safe school environment for children and the legal implications of this burden.  Ms. Eisenberg's article, "Reviewing Special Education", provids a comprehensive overview of the laws governing the education of children with disabilities.
